Belgian lawyer: Palestine is the most violated issue at the level of international law

Written by Hassan Al-Balaawi
Belgian lawyer Alexis Dossoaf, honorary president of the League for Human Rights in Belgium, says that the Palestinian cause is not the bloodiest of the conflict issues that rage in many regions of the world in the Middle East and Africa, but it is the oldest in the region and the most obvious in international law because it represents the most violating case of justice The human level as a whole, and in it all forms of violation of international law are concentrated, which is ignorant of a global issue.
Dossoav learned about the Palestinian cause when he was a student at the Faculty of Law at the University of Louvain-Leneuve, Belgium, in the early nineties of the last century. He was more interested in international law and a follower of international politics, and he used to read newspapers and books permanently. He added that he met a Palestinian student coming from the village of Wadi Fuqin near Beit Meat and his name is Raed Attia, who played a catalytic role in getting to know more about the Palestinian cause since its inception and understanding its historical details. Since that date, he began to follow the Palestinian issue and was active in the solidarity movements in support of Palestine.
Lawyer Doslaw, who is the vice-president of the International Federation for Human Rights, considers that the Gaza Strip, in terms of international law, is still under occupation, despite the redeployment of the Israeli occupation army in 2005 and the evacuation of its settlers. Until now, it is under the full control of the occupation army, which waged several bloody wars.
Dossoav appreciates the legal battle waged by the State of Palestine in the face of the occupying power and its main ally, the American administration, armed with all international covenants and treaties on international and humanitarian law, saying that "Palestine may not be able, by virtue of the gross imbalance in the balance of power, to achieve the great victory, but it has been accomplished over the past years." Small victories eventually lead to the great victory that wrests her freedom, "giving a number of examples, including the accession of the State of Palestine to the International Criminal Court and its submission of a number of judicial files against the leaders of the occupation as cases related to war crimes and the important decisions that Palestine confiscates in the Human Rights Council."
Nevertheless, he believes that the State of Palestine should not put its eggs in one basket by relying only on international courts, but by turning to national courts within European countries, giving an example of the experience in Belgium and previous attempts to prosecute war crimes against the Palestinian people, and the blatant example of that is a previous law in Belgium in the name of international jurisdiction, which allows the trial of any person accused of committing war crimes and against humanity, regardless of whether the accused or the victim is Belgian, or the place of the crime was Belgium. Deputy Prime Minister of Belgium and Minister of Foreign Affairs (and he is the father of Charles Michel, President of the European Council and former Prime Minister of Belgium) in 1999, and he was approved by the Belgian Federal Parliament, and a number of officials in African countries have already been prosecuted and brought to Belgian justice, but when it came to In 2002 and 2003, requesting the trial of US President George Bush for his responsibility for war crimes and against humanity in Iraq and Afghanistan, and the trial of Israeli Prime Minister Ariel Sharon. His responsibility for the Sira and Shatila massacre in 1982. All American and Israeli pressures and threats were exerted on Belgium to cancel or amend this decision, and among the threats was the transfer of the NATO headquarters from Brussels to another European capital. He links any prosecution in Belgium with the meaning that the victim or the accused is Belgium, or resides in Belgium, or that the place of the crime is Belgium, and it was not available, neither in the file of America’s crimes in Iraq or Afghanistan, nor in the file of the Sabra and Shatila crime, and therefore the two files were closed.
From this standpoint, that is, searching for a link with Belgium in presenting any crime to the Belgian judiciary concerning the Palestinians. Dossoaf succeeded with a number of his fellow Belgian lawyers in raising the case of a Palestinian citizen from the Gaza Strip who holds Belgian citizenship, whose farm was burned by Israeli warplanes with phosphorus, during the 2009 aggression. Which, in the view of the Belgian lawyers, constitutes a full-fledged war crime. Accordingly, the complaint was submitted before the Belgian judiciary, and a judge was identified to follow the file. The investigation began and took time, and this is expected, until Dossoaf and his colleagues succeeded in 2017 in persuading the Belgian federal deputy to listen to the former Israeli foreign minister. Tzipi Livni, during her scheduled visit to Belgium, because she was on the list of persons charged with the crime of bombing the farm of the Belgian citizen of Palestinian origin in Gaza. The former Israeli minister was afraid of this issue of hearing and that it would lead to her suspension, so she decided to cancel her trip to Brussels under an excuse flimsy
The honorary president of the Association for Human Rights in Belgium believes that what happened to Livni constitutes a small victory, especially since she canceled after months of her visit to Britain, which indicates that Israeli officials take seriously what may result from complaints that are submitted before European national courts to reach Convinced of the need to repeat the complaints, on the same what happened in Belgium before the national courts in Europe, whether by Palestinian citizens holding European nationalities, or by filing lawsuits against Israeli persons involved in war crimes and holding European nationalities, as is the case with a Belgian Jewish citizen holding Israeli citizenship who boasted publicly that she It heads a civil organization working to support Israeli settlements in the West Bank, which have been opened A judicial file  for the Belgian justice a year and a half ago, and an investigative judge was appointed to follow up on her file. It is expected that the judge will request to hear her about her participation in a war crime, which is settlement. The judge was provided with a complete file of 70 pages on settlement as an act contrary to international law and therefore as a full-fledged war crime. And this movement towards settlement from this angle is complementary to the Palestinian movement in the International Criminal Court.
The Vice President of the International Federation for Human Rights calls these attempts the term "judicial gang war" everywhere that leads to an end to the immunity enjoyed by the Israeli government and its army, and makes the Israeli officials involved in war crimes persecuted persons in the world closer to pariahs, and "judicial guerrilla war It takes time and also requires significant capabilities, including financial ones.
In this context, the Belgian jurist outlines the achievements of many European civil initiatives in solidarity with Palestine at the legal level, including in particular the Russell Court on Palestine, which is a popular court of opinion, established in March 2009 in order to mobilize public opinion so that the United Nations and member states take measures Necessary to put an end to Israel’s evasion of international accountability for the crimes it commits, as this court held several conferences, the latest of which was in Belgium in September 2014, in support of the boycott campaigns against Israel, which achieved tangible results in the severing of a number of European and Belgian municipalities and universities, relations established by some institutions with Israeli settlement.
In 2012, at the invitation of the Palestinian Embassy in Belgium, a delegation of 10 Belgian lawyers, Dossoav was one of them, went to Palestine to see the situation in the field, for a period of 10 days, during which they learned about all aspects of the Palestinian cause, and this visit deepened the lawyers’ awareness of the Palestinian issue, and there he met the lawyer In the various segments of Palestinian society, he got acquainted closely with the suffering of the Palestinian people as a result of the occupation policies of planned and concentrated settlement, confiscation, siege and division of the Palestinian land. Israel-Palestine: In the Depth of Decay, 10 Days for Understanding. This book, which quickly goes back to history with field testimonies, can be read within 3 hours. This book was successful in Belgium and some French cities, which increased public awareness of the Palestinian reality. In Belgium at the time, he declared, in his book, anti-Semitic.
Doslaw's last visit to Palestine was in September 2022, in his capacity as Vice President of the International Federation for Human Rights, in solidarity with the legal "Al-Haq" organization in Palestine, whose president, Shawan Jabarin, occupies the position of Secretary-General of the Federation, which includes 187 organizations in the world, when the authorities announced The occupation is the "Al-Haq" organization with six Palestinian civil organizations as terrorist organizations. Representatives of "Amnesty International" and "Human Rights Watch" participated in this visit. The international human rights delegation held a press conference in the "Al-Haq" organization, which was closed by the occupation authorities and put red candles In defiance of an Israeli occupation law issued in 2015, according to which every person who is inside the headquarters of a terrorist organization classified as a "terrorist" is considered a "terrorist", the members of the international delegation are also "terrorists" in solidarity with their fellow "Palestinian terrorists".
